On September 10, 2023, at about 7:05 PM, Milpitas Police Officers responded to the report of a domestic violence incident at a residence on Spence Avenue. When officers arrived, they saw the suspect in front of the home. When the officer attempted to detain the suspect, he ignored the officer’s commands to stop and ran into the side yard of the residence. Additional officers responded to establish a perimeter around the home, and they deployed a drone to search the area for the suspect.

The surrounding area, including the nearby Spangler Elementary School, was checked immediately after the suspect ran from officers. Based on all available information at the time, officers believed the suspect ran into the house. Officers made several loudspeaker announcements and phone calls to the suspect to communicate with him and gain his cooperation. Officers believed the suspect was in the home and ignoring them.

Officers presented the facts of the investigation to a Judge who authorized a warrant for the suspect’s arrest. During the investigation, officers developed information that led us to utilize the SWAT team to serve the warrant. Due to the late hour and to serve the warrant in the safest manner possible for the suspect, officers, and community, the SWAT team waited until daylight hours to enter the home and serve the warrant. At about 7:23 AM, our SWAT team served the arrest warrant however the suspect was not located. It was later determined that the suspect did not enter the home after fleeing from officers.

To ensure the safety of the community, officers were deployed around the residence during the entirety of the incident. Although the presence of police activity can be unsettling, the Milpitas Police Department is committed to utilizing all available staffing and resources to maximize the safety of our officers and our community.

We would like to thank our public safety partners at the Milpitas Fire Department and the Sunnyvale DPS for their assistance during this event.
